*The State of Delaware does not pay for these types of claims (pothole, slip and fall in a state-owned facility, fallen tree, etc.) due to the doctrine of sovereign immunity. The State cannot be required to pay damages or claims unless there is a specific law that allows the claim to proceed and authorizes payment. Only the General Assembly can waive sovereign immunity through legislative enactment. Sovereign immunity is waived if the State purchases insurance that would cover the loss. The State has not purchased general liability insurance.

Reporting a Claim FAQs

The Delaware Claims Online Reporting Portal is an online portal for the public to submit claim reports to the State of Delaware – Insurance Coverage Office.

Automobile – report any incident or accident involving a State of Delaware state-owned vehicle. The State Vehicle Tag Number is required for this type of claim to be reported online.

General Liability – report any complaint of injury or property damage that occurred on State of Delaware property or roadways. (i.e., potholes, fallen tree on property)

Mailbox – report damage to property caused by the Delaware Department of Transportation during maintenance operations. (i.e., mailbox or fence damage during mowing and snow removal operations)

Claims against the State of Delaware can be submitted using the State of Delaware Claims Online Reporting Portal by using the "File Your Claim" button at the top of this page.
